HC allows PG NEET counselling, asks DME not to publish Final All India Quota NEET 2019 Admission results.


The Madurai bench of the Madras high court has directed the directorate of medical education not to publish the final list for NEET postgraduate (PG) admissions in Tamil Nadu medical colleges, but has allowed the counselling, which began on Monday, to continue.


 

On the Other Hand The Lucknow bench of Allahabad high court on Tuesday quashed the provisions of a state government notification of March 9, whereby it was provided that MBBS passouts who had obtained their degree under all-India quota for MBBS courses from medical colleges situated outside UP were eligible for admission to PG courses in the state through NEET PG-2019. Passing the order, a bench of Justice Alok Mathur said, “The state government by permitting students domiciled in Uttar Pradesh to participate in the counselling for NEET PG-2019 against the seats of state quota, is in sense giving ‘preference’, when looked into the fact that students who are domicile of other states having studied outside Uttar Pradesh are not allowed to participate in the selection process.”


 

NEET PG Counselling as scheduled shall go on, but the same shall not be finalised for a period of two weeks. Call the matter after two weeks.

The directive came in view of the petition by a Madurai-based Dr P Jeyakumar who is working as an Assistant Surgeon at the Government Rajaji Hospital in Madurai since 2013. The doctor sought an interim stay on the counselling process and annulment of a certain clause in the recently notified incentive scheme in the state. Medical Dialogues had earlier reported about the order issued by the state health department which states that incentive marks will be awarded to the in-service NEET PG candidates for their service rendered in the remote difficult rural areas for admission to Post Graduate Medical Courses by considering their working places. These working places are segregated into three categories on the basis of difficulties in working at these places. The clause against which the petitioner contended is the awarding of 10% of the marks secured in NEET per year of service to the Health Officers who are working in Tamil Nadu Public Health Services for getting a Post Graduate seat in MD (Community Medicine) alone.


As mentioned in the report by TOI, the petitioner stated that this is in violation of the Postgraduate Medical Education Regulations 2000 and Supreme Court directions in the matter. The petitioner pointed out that for all these years, 10% of NEET marks secured by medical officers were awarded as an incentive and that he was of the impression that he would be eligible for the incentive. However, by passing the GO, the department had categorized the working place for availing incentives under four categories – difficult areas in hills, difficult areas in plains, remote and rural areas. While the original regulations allow for incentive marks only to those in difficult and remote areas, the new category will favour health officers in municipalities and corporations and they do not fall under either difficult or remote areas. Allowing the petition, the bench of honourable Justice R Mahadevan issued the notice to the DME not to publish the final list of the PG medical admissions.

INEFFECTIVENESS OF THE PARLIAMENT


Many important bills like IBC, Juvenile Justice Act, Person with Disabilities Act, Prevention of Corruption Act, Aadhar Act, GST etc. are passed in the 16th lok Sabha. But the passage of Aadhar bill as a money bill undermines the Rajya Sabha and also the passage of 124th constitution amendment bill which enables 10% reservation for economically weaker section raises the people's eyebrows on the effective functioning of Parliament


PROCEDURE FOR PASSING THE BILLS

  • First reading (asking for leave to introduce the bill)

  • Publication in the Gazette

  • Reference to standing committee

  • Second Reading

  • General discussion and referring to standing committee

  • Clause by clause discussion

  • Third reading (support or reject the bill)

  • Bills in other House

  • Assent of President


VIOLATION OF THE PROCEDURE

  • But due to vote bank politics most of the bills violates the rules of procedure like The Bill was not circulated ahead of being introduced.

  • There was hardly any time between its introduction and final discussion.

  • It was not examined by a committee. Barring a few small parties, none of the larger.

  • Opposition parties asked for the Bill to be carefully considered by a parliamentary committee — even in the Rajya Sabha


IMPACTS OF BYPASSING THE PROCEDURE


Members of Parliament had only very less time to read and understand the intricacies present in the bill leading to a poor discussion and lack of proper scrutiny.


The Bill also bypassed the usual practice of referring to Parliamentary Standing Committee which Members of Parliament use a measure to solicit public feedback and interact with experts before forming their recommendations.



OTHER FACTORS RESPONSIBLE FOR INEFFECTIVENESS OF THE PARLIAMENT


Anti-defection

  • Interferes with members freedom of speech

  • Reduces accountability of the government to the parliament and the people

  • Members unable to express his belief or the interests of his constituents

Lack of recorded voting as a norm

  • Reduces the accountability of the MP as voters don’t know which way they voted on each issue

Party affiliation of the Speaker

  • Making her dependent on the party leadership for reelection prospects

Insufficient time and research support to examine Bills, and the lack of a calendar

  • Parliament is held at the convenience of the government


WAY FORWARD


  • Anti-defection law should be only applied to confidence and no- confidence motions (Dinesh Goswami committee).

  • Instead of making speaker the authority of disqualification, it must be done by judiciary or the president on the advice of election commission.

  • All the voting of the MP must be recorded so that the voters can know which way they voted on the issue.

  • Independence of the speaker must be secured like in UK.

  • Working days of the Parliament must be regularised it must not on the will of ruling party.

  • Every bill must follow the rules of procedure.

  • Usage of guillotine by the speaker must be reduced.

  • Parliament has a central role to secure the interest of citizens. It is the primary body of accountability that translates the wishes and aspirations of citizens into appropriate laws and policies.

NEET 2019 Result Date is June 5, 2019 and NEET tie breaker rules



NEET 2019:


National Eligibility cum Entrance Examination, NEET 2019 would be conducted for admissions to undergraduate medical and dental courses in the country. The medical entrance examination would be conducted by National Testing Agency, NTA on May 5, 2019 from 2:00 pm to 5:00 pm. More than 12 lakh candidates are expected to have registered for the examination. With such numbers, chances of students scoring same marks is high. Here is a look at how NEET 2019 rank would be calculated and what is the tie-breaker criteria.



RULES FOR TIE – BREAKER


In case of a tie in marks – the following rules shall act as tie – breaker


1.  Candidate having higher marks in Biology

2.  Candidate having higher marks in Chemistry

3.  Candidate having lesser number of attempted wrong answers

4.  Candidate who is older in age


NEET UG 2019
NEET 2019 Tie-Breaker Rules

NEET Result 2019 is expected to be released on June 5, 2019. The minimum NEET cut off marks to qualify the examination will be 50% (for General category) & 40% (for Reserved category). The results will be available at the official portal i.e. nta.ac.in in the form of score card. The scorecard for NEET 2019 contain candidates’ All India Rank (quota and category), overall & sectional marks and percentile. The counselling procedure will be started after the result declaration.


This year, NTA has scheduled the examination for May 5 in offline mode. Candidates qualifying the examination will have an opportunity to grab a seat into approximately 65,000 MBBS and 25,000 BDS seats in medical and dental colleges across India. There will be no provision of re-evaluation/re-checking of the answer sheets. After the declaration of cutoff, an All India Merit List will be prepared by NTA, containing names of qualified candidates with their corresponding NEET Rank.



NEET PG Cut off 2019 – The National Board of Examinations (NBE) is the responsible body for releasing the NEET PG 2019 cut off. The authority has released the result of NEET PG 2019 on January 31. Along with the result, the cut off of NEET PG has been released. The mode of release of the cut off of NEET PG 2019 is only online. The qualifying percentile for General category aspirants is 50 and its equivalent NEET PG cutoff scores is 340. The authority hiked the NEET PG cutoff 2019 scores for general category by 19 marks, while for SC/ST/OBC aspirants, minimum scores has increased by 14 marks. NBE, in a recent notice, has issued the exam statistics of NEET PG 2019.
